UK Spill Kit Regulations: What Your Business Needs to Know

Why Spill Preparedness Is a Legal Requirement

If your business stores oil, fuels, or hydraulic fluids — or if there is any realistic risk of a spill reaching a watercourse, drain, or the ground — you have legal obligations to be prepared to contain and clean up spills promptly. Getting this wrong can result in significant fines, criminal prosecution, and serious reputational damage. This guide explains the key UK regulations, what equipment you are likely to need, and how to assess what is right for your site.

Key UK Legislation

Environmental Protection Act 1990 — Section 34 (Duty of Care)

The Environmental Protection Act places a general duty of care on all businesses to manage their waste — including spilled materials — responsibly. Under Section 34, businesses must take all reasonable steps to prevent the escape of controlled waste. A spilled hydraulic fluid that reaches a watercourse constitutes both a controlled waste issue and an environmental pollution incident that can trigger formal enforcement action.

Water Resources Act 1991

It is a criminal offence under the Water Resources Act to cause or knowingly permit polluting matter to enter controlled waters, which includes rivers, streams, groundwater, and coastal waters. The Environment Agency treats this seriously: prosecution and substantial fines are a real and well-documented consequence of a poorly managed spill, not a theoretical risk.

Control of Pollution (Oil Storage) (England) Regulations 2001

These regulations apply to any business in England storing more than 200 litres of oil — including mineral oils, lubricating oils, hydraulic oils, and fuels. Key requirements include:

  • Secondary containment capable of holding at least 110% of the largest single container’s capacity, or 25% of total storage capacity, whichever is greater
  • Storage containers must be in good condition and protected from accidental damage
  • Fill points and sight gauges must be positioned within the secondary containment bund
  • Oil pipes, valves, and delivery equipment must be maintained in good working order

Scotland and Wales have their own equivalent regulations with broadly similar requirements. Northern Ireland follows the Control of Pollution (Oil Storage) Regulations (Northern Ireland) 2010.

Health and Safety at Work Act 1974

Beyond the environmental regulations, HSWA requires you to protect employees and visitors from harm. Spilled hydraulic fluid creates slip hazards; uncontrolled spills of flammable oils can present fire risks. Adequate spill response equipment is part of your broader health and safety obligations under HSWA and the associated Management of Health and Safety at Work Regulations.

What Spill Kit Does Your Business Need?

The right spill kit depends on what you are storing, how much, and where. There are three main categories:

  • Oil-only spill kits: Contain hydrophobic absorbents that soak up oil but repel water. Ideal for outdoor use or around drains where you need to absorb oil selectively without saturating absorbents with rainwater.
  • General purpose (maintenance) spill kits: Absorb both oil-based and water-based liquids. Suitable for indoor workshops, plant rooms, and machine shops.
  • Chemical spill kits: Contain chemical-resistant absorbents for use with aggressive or hazardous fluids. If you handle anything beyond standard mineral-based oils, check compatibility.

As a practical guide:

  • Small workshop with minimal oil storage: a 30–50 litre general purpose kit is typically sufficient as a minimum provision
  • Sites with IBC storage tanks or multiple drums: a dedicated 200+ litre capacity kit located at each significant storage point
  • Outdoor oil storage near drains or watercourses: oil-only kits supplemented with drain covers, booms, or absorbent socks positioned to intercept runoff

Penalties for Non-Compliance

The consequences of a pollution incident and inadequate spill preparedness can be severe:

  • Unlimited fines in the Crown Court under the Environmental Permitting Regulations
  • Criminal prosecution of company directors and managers in egregious cases
  • Clean-up costs that fall entirely on the polluter, which can be very substantial for groundwater or watercourse contamination incidents
  • Reputational damage and potential loss of operating permits or environment licences
