Why Spill Preparedness Is a Legal Requirement
If your business stores oil, fuels, or hydraulic fluids — or if there's any risk of a spill reaching a watercourse, drain, or ground — you have legal obligations to be prepared to contain and clean up spills quickly. Getting this wrong can result in significant fines, criminal prosecution, and serious reputational damage.
This guide explains the key regulations UK businesses need to be aware of, what equipment you're required to have, and how to assess what's right for your site.
Key Legislation
Environmental Protection Act 1990 — Section 34 (Duty of Care)
The Environmental Protection Act places a general duty of care on all businesses to manage their waste — including spilled materials — responsibly. Under Section 34, businesses must take all reasonable measures to prevent the escape of controlled waste. A spilled hydraulic fluid that reaches a watercourse is both a controlled waste issue and an environmental pollution incident.
Water Resources Act 1991
It is a criminal offence under the Water Resources Act to cause or knowingly permit polluting matter to enter controlled waters (rivers, streams, groundwater, coastal waters). The Environment Agency takes this seriously: prosecution and substantial fines are real consequences of a poorly managed spill.
Control of Pollution (Oil Storage) (England) Regulations 2001
These regulations (commonly called the Oil Storage Regulations) apply to any business in England storing more than 200 litres of oil — including mineral oils, lubricating oils, hydraulic oils, and fuels. Key requirements include:
- Secondary containment capable of holding at least 110% of the largest container's capacity (or 25% of the total storage capacity, whichever is greater)
- Containers must be in good condition and protected from damage
- Fill points and sight gauges must be within the secondary containment
- Oil pipes and valves must be maintained in good condition
Scotland and Wales have their own equivalent regulations with broadly similar requirements.
Health and Safety at Work Act 1974
Beyond the environmental regulations, you also have a duty under HSWA to protect employees and visitors from harm. Spilled hydraulic fluid is a slip hazard; uncontrolled spills can also cause fires. Having adequate spill response equipment is part of your general health and safety obligations.
What Spill Kit Do You Need?
The right spill kit depends on what you're storing, how much, and where. There are three main categories:
- Oil-only spill kits: Contain hydrophobic absorbents that absorb oil but repel water. Ideal for use outdoors or around drains where you need to contain oil without also saturating absorbents with rainwater.
- General purpose (maintenance) spill kits: Absorb both oil-based and water-based liquids. Suitable for indoor use in workshops and plant rooms.
- Chemical spill kits: Contain chemical-resistant absorbents for use with aggressive fluids. If you're handling anything other than mineral-based oils, check compatibility.
As a general guide:
- Small workshop or plant room with minimal stored oil: a 30–50 litre capacity general purpose kit is often sufficient as a minimum
- Sites with IBC storage or multiple drums: a dedicated 200+ litre capacity kit located at each storage point
- Outdoor storage near drains or watercourses: oil-only kits with drain covers or booms as appropriate
Penalties for Non-Compliance
The consequences of a pollution incident and/or inadequate spill preparedness can include:
- Unlimited fines in Crown Court under the Environmental Permitting Regulations
- Criminal prosecution of company directors
- Clean-up costs (the polluter pays — these can be very substantial)
- Reputational damage and potential loss of operating licences
The Environment Agency publishes enforcement and prosecution data — it is not a theoretical risk.
